1, that could have been a easy fix, get plywood and wrap it in tin foil and put it over the hole temporarily geez

You'd sue...for what exactly? Did she suffer any permanent physical damage? Doesn't look like she even scratched herself. Any permanent mental anguish? She would have to prove psychological distress or something of that nature to even think of winning anything. Plus, she'd never work again because no one would hire her after she sued.
